Does minimum wage include tips?
Tipped employees include those who depend on tips from customers to boost their earnings. A tipped employee typically receives more than $30 per month in tips, as per the Department of Labor.
Employees who are tippy must earn an hourly basic wage that is $2.13 for an hour. It is also known as a cash wage. This cash wage is paired with tips to reach the minimum wage in the federal government which is $7.25 per hour. Those tips are considered a "tip credit," and allows businesses to pay employees below the federal minimum wage.
Employers may take up to $5.12 per hour of tips against a worker's earnings. If an employee's earnings (at at least $2.13 for an hour) plus tips is below $7.25 for an hour the employer is required to make the extra.
Minimum tipped wages and maximum tip credits differ by state and even city.
Washington, D.C., has the most tipped workers' minimum wage of all workers in the country. In the election of 2022, Washington, D.C., residents voted to increase incrementally the minimum wage for tipped employees each year until July 1st, 2027. Then the minimum wage for tipped employees will be adjusted to be the same minimum wage as the nontipped minimum wage that year. The current minimum wage is $5.35 an hour to workers who are tipped and $16.10 on nontipped staff.
